I annex the similar Straits Ordinance, Cap. 169.
It will be seen that the arrangements for review of the
rate of contribution are explained in the preamble.
This has, I presume, no statutory effect, but serves to
put the arrangement on record.
Might we not send H.K. the Straits Ordinance and suggest
that cl. 5 of the H.K. draft should be relegated to the
preamble, or alternatively, if this satisfies the Legislative
Council, should merely be embodied in a preliminary statement
on the introduction of the Bill.
I do not see any reason for treating the proviso
to sec. 5 any differently. There is no undertaking that the
contribution will not be allowed to fall below £350,000.
As to cl. 4, should not this begin, on the analogy of
sec. 4 of the Straits Ordinance, "Notwithstanding anything
contained in sec. 2" ?
I don't quite like hinting that the draft should be
examined by the Legal Advisers in the Colony. Presumably
no Bill is presented to the Council without such
examination.
